Last Will and Testament

The centerpiece of an estate plan is a document that distributed your assets when you die. This is usually a Last Will and Testament, and it may include a trust. A Last Will & Testament can be used to distribute your property (for example, automobile, jewelry, collectables) to the beneficiaries of your choice, name an executor (person who administers the estate), and name a guardian of the person (person(s) who will take care of your children if you die before your children become adults) and a guardian of the estate (one who manages the minor’s property). If you die without a will (“intestate”) state law determines who receives your property, and who will care for your minor children. If you are married, a portion of your property will be distributed to your surviving spouse, and if you have children some of your property will go to your children. This can cause difficulty in some situations.
